Sales conditions and rules

Zygmunta Starego 6/30, 44-100 Gliwice, email: info@acmsse.com entered in the Register of Associations, Other Social and Professional Organizations, Foundations and Public Health Care, District Court in Gliwice, X Division of the National Court Register, KRS 0000240346, which has been given VAT number: 631-24-70-612, REGON number: 240168386 hereinafter referred to as ACMSSE carries out a promotional sale of scientific publications and journals published by the International OCSCO World Press and academic textbooks and scientific books at the lowest prices for MSc and PhD students,  scientific staff, libraries and industrial companies at http://www.acmsse.com  

§ 1.

Terms of the realisation of the order

1. A Client of the service can only be an adult, a physical or legal person, regardless whether engaged in business or not.

2. The Client may place orders:

a)  24 hours a day via the website http://www.acmsse.com

b) The Client after registering and logging in, place an order, pointing to the book / journal, which is interested in, by using the option "make an order"

3. The user’s account is owned by ACMSSE and can be removed for any reason. If you have any questions or problems, please contact us at the address info@acmsse.com

4. The Client making an order, signs an agreement to sell the ordered journals/books with ACMSSE.

5. The Client shows in the order:

a) the annual subscription ordered a journal or ordered a single journal numbers or the ordered book;

b) the address for which the invoice is to be issued by the full name of the institution,

c) VAT number of the institution,

d) a contact phone number,

e) an e-mail address to confirm the order,

f) a delivery address,

g) a delivery method,

h) a statement of acceptance of an invoice without signature.

6. The Condition of the realisation of the order is a proper making of the ordering process.

7. After making an order the Client will receive automated e-mail confirming the fact of making an order and its specification. The order must be confirmed by sending an automatic return an e-mail, as instructed. Orders are accepted at the moment of sending by ACMSSE  proper "order status". Sending status is also a confirmation of the sale agreement between the Client and the Association for Computational Materials Science and Surface Engineering. The subject of the agreement covers the goods listed in the status. Making an order by the Client means the acceptance of resolutions of those regulations.

8. The order is realised after the bank transfer made to the bank account of ACMSSE within 14 days from the date of the confirmation of the order by the Client and the Association for Computational Materials Science and Surface Engineering. The lack of the bank transfer to the ACMSSE bank account  within the given deadline will automatically cancel the order about what the client will be informed automatically by e-mail confirming the fact of the order cancelation.

9. In some cases, ACMSSE may contact the Client via e-mail or phone to confirm the order or clarify ambiguities.

10. The Introduction to cart selected journals / books is not synonymous with the purchase.  The journal/ book included in the Client's basket remain the exclusive property of ACMSSE until the end of the ordering process and make a deposit laid down in this Regulation at the height indicated in the automated e-mail confirming the fact of placing an order.

11. The delivery of ordered journals / books will be made only when ordered goods are in the ACMSSE warehouse.

12. The order is made to the address specified by the Client in the order.

13. ACMSSE is not responsible for non-delivery or delay in delivery of the ordered goods or perform the contract, resulting from incorrectly specified by the Client or inaccurate delivery address.

14. In the partial lack of books / journals in the warehouse which are included in the order, as soon as possible ACMSSE sends a message to the Client’s email address client, indicated in the order form, with information about a lack of goods or possible problems with the order realisation. A message also contains a request to take a decision of the Client about the further steps in the order realisation.  

15. In the situation described in section 14 depending on the situation the Client can:

a) resign from the order completely;

b) agree to a partial order realisation

16. In the situation described in paragraph 15, and in the lack of return information from the Client within 48 hours on how to proceed in the order, ACMSSe reserves the right to: a) realise the order partially  and deliver the goods, which are at the moment of the order realisation available in the warehouse and to cancel the remaining part of the order and return the amount due to the Client for the unrealized order; b) cancel the order totally.  

§ 2.

Prices of goods

1. ACMSSE publishes information on its offers at the page http://www.acmsse.com  and offers a promotional sale of books and journals.

2. Prices at ACMSSE Online Shop:

a) include VAT and are given in EURO and Polish zloty;

b) the basis for the conversion prices stated in EURO is the average EURO exchange rate used for the public orders for a given calendar year published annually by the Minister of Finance of Poland; The prices of domestic Clients in PLN are established according to that rate. c) published at the offered journal/book  does not contain information on delivery costs;

3. The price of the journal / book which is at ACMSSE webpage  at the time of order by the Client is binding and final;

4. Information on the total order value is presented at the page http://www.acmsse.com , after the Client choose the form of order delivery;

5. ACMSSE reserves the right to make current changes in the prices of offered journals / books as well as carry out and cancel all kinds of promotions and sales.  

§ 3.

Modification of Orders

1. The Client can make changes in the order up to 14 days from the date of the confirmation of the order by the Client.

2. Changes can be made by contacting ACMSSE by e-mail to the address info@acmsse.com .

3. Changes can apply to the resignation of the whole order. The repayment will be made to the Client account from which the payment was made after deduction of operating costs, which may be fixed at a flat rate by ACMSSE.  

§ 4.

Methods of payment and the start of the contract

1. The payment for a journal / book to be delivered in Polish or outside its borders must be made by bank transfer – the order realisation will begin after the payment in ACMSSE bank account. A purchase order (the number is displayed when accepting orders and is given in by e-mail order confirmation sent automatically) should be given on the transfer order.  

§ 5.

Time of order realisation

1. Ordered journals or books on Polish territory are delivered through the Polish Post to the address indicated by the Client, as a registered parcel with receipt confirmation within ca. 10 working days (the time of completion of the order and delivery) from the date of income to a bank account;

2. Orders outside of Polish territory are provided through the Polish Post as air mail.

3. ACMSSE is not responsible for the longer delivery time committed by the Polish Post

4. Due to the possibility of ordering annual subscriptions of journals periodicals a given issues will be delivered to the 15th day of each month.

5. Receiving the parcel from the Polish Post must be confirmed by the attached receipt confirmation. At the time of  receipt confirmation the ownership of journals / books passes to the Client.

6. The invoice will be sent by Polish Post to the indicate address together with the parcel, and in the case of annual subscriptions together with the first part.  

§ 6.

Terms of complaints (notification of non-conformity)

1. ACMSSE within 14 days will respond to the Client’s complaints and notify it of its settlement;

2. A prerequisite to ACMSSE considered the complaint is SKNoMiIP delivery to the premises through the Polish Post (economic package) advertised magazines / books along with the invoice, document the return / complaint by attachments and original packaging;

3. In the case of considering the complaint in favor of the Client - the Client will replace SKNoMiIP advertised magazine / book on relevant within 14 working days from receipt of the complaint;

4. Where SKNoMiIP not have magazines / books to be exchanged, you will receive a refund of the advertised magazine / book within 14 working days from receipt of the complaint;  

§ 7.

Terms of Guarantee

1. All goods available in ACMSSE be exchanged if the journal / book is not inconsistent with the order;

2. ACMSSE is not responsible for mechanical damage of the registered mail. At the time of receipt of goods the Client is obliged to check a parcel and tell about any mechanical damage to the employee of the Polish Post and submit a written complaint.

3. Differences arising from the Client individual computer settings (colour, proportions, etc.) cannot be the basis of complaints of purchased journals / books.  

§ 8.

The right of withdrawal / Returns

1. Resignation of the whole order or its part may be made if the order has not yet been completed, and books or journals have not yet been sent. To cancel please contact via e-mail to the address info@acmsse.com .

2. In the lack of journals / books in stock and inability to perform the Client’s order, ACMSSE has the right to withdraw from the agreement not later than thirty (30) days from the date of its conclusion. If a transfer to the ACMSSE bank account is made, the payment for the book / journal will be returned to the Client

3. In case the order was paid in foreign currency, the refund will be always at the average rate of the National Bank of Polish at the date of making  the return. ACMSSE is not resposible towards the Client for the appearance of possible differences of the exchange rate.  

§ 9.

Personal data

1. By registering at the ACMSSE website at http://www.acmsse.com  the Client consents to put his/her personal data in the ACMSSE database and processed for marketing purposes exclusively by ACMSSE.

2. Personal data is protected in accordance with the Law of 29.08.1997. "The protection of personal data" (Journal of Laws No. 133 item. 883) to prevent access to them by third parties.

3. Lack of consent to the processing of personal data makes the order realisation by ACMSSE impossible.  

§ 10

Final provisions

1. The presence of the journal / books in the price list at the ACMSSE website does not mean the availability of goods and the possibility of the order realisation.

2. ACMSSE is not responsible for the blocking by the mail server administrators messaging to the email address specified by the Client and for the removal and blocking of emails by software installed on the computer used by the Client.

3. Differences arising from Client individual computer settings (colour, proportions, etc.) cannot be the basis for complaint and return of the purchased journals / books in ACMSSE.

4. ACMSSE  makes all the efforts so that the content of an offer of  journals / books as accurately as possible correspond to reality. Due to the possibility of errors during carried out renovation (eg. the price, configuration, etc.) - any discrepancies will be adjusted during the order confirmation by ACMSSE.

5. In matters not regulated by those rules provisions of the Civil Code and the provisions of the act on specific terms of consumer sales and changes of the Civil Code and the Law on protection of consumer rights and liability for damage caused by dangerous products.

6. Those regulations apply from 1 January 2008.

7. ACMSSE reserves the right to change the Rules. Any changes to those Terms and Conditions of Sale apply from the date of publication at the website http://www.acmsse.com .

8. The competent court for any possible disputes that may arise on the background of implementing the provisions of these Regulations is the court competent for ACMSSE seat.
